1. Introduction

Welcome to SimFoundry ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website https://www.simfoundry.gg/ (the "Site") and our services.

By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Site.

Legal Entity:The Site is operated by Steven Worrell (Sole Trader), based in the United Kingdom.

2. Nature of Our Service (The "Directory")

2.1. Aggregator Only

‍SimFoundry is a directory and discovery platform for sim racing mods. We do not host mod files directly on our servers. All download buttons and links on the Site direct users to third-party websites (such as Overtake, Patreon, or private creator sites) where the files are hosted.

2.2. No Responsibility for External Content

‍Because we do not host the files, we have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that SimFoundry shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such third-party websites.

3. User Accounts

3.1. Registration

‍To access certain features of the Site (such as liking mods or viewing specific filters), you must register for a free account (managed via Memberstack). You agree to provide accurate, current, and complete information during the registration process.

3.2. The "Value Exchange" (Free Accounts)

‍SimFoundry operates on a value-exchange model. By registering for a Free Plan, you strictly agree to subscribe to our marketing and newsletter communications. You acknowledge that this email subscription is the consideration (payment) provided in exchange for free access to our premium directory features.

• Opt-Out: You may unsubscribe from these communications at any time via the link in our emails

3.3. Paid Plans (Patreon)

‍Certain features may be restricted to paid supporters. Paid plans are managed entirely through Patreon.

• Payment Processing: We do not process payments or store credit card details. All financial transactions are handled by Patreon in accordance with their own Terms of Service.
• Access: We manually link your SimFoundry account to your Patreon status. If your Patreon subscription lapses, your access to paid features on SimFoundry will be revoked.

4. Mod Creators & Verification

4.1. Claiming Ownership

‍If you are the creator of a mod listed in our directory, you may request to "Claim Ownership" of the mod page. This allows you to customise the page and receive a "Verified" badge on your profile.

4.2. Verification Process

‍Verification is a manual process subject to our approval. To claim ownership, you must:

1. Submit a verification request form.
2. Complete a specific task (as directed by us) to prove you control the original source of the mod.

4.3. Verified Status Rights

‍We reserve the right to:

• Reject any verification request at our sole discretion.
• Revoke a Verified Badge and remove ownership privileges at any time if we discover the claim was fraudulent, if the creator violates these Terms, or if the mod is removed from its original host.

4.4. Disputes

‍If a dispute arises regarding the ownership of a mod listed on SimFoundry, we reserve the right to hide or remove the listing entirely until the dispute is resolved between the parties. We are not an arbiter of intellectual property disputes.

5. Intellectual Property

5.1. Mod Ownership & Disclaimer

‍SimFoundry is a discovery platform, not a publisher or creator of the mods listed. We do not claim any ownership rights, intellectual property rights, or creative credit for the mod files, images, or assets listed in our directory.

• All mod files, download links, and associated creative works remain the sole property of their respective creators.
• Our role is strictly limited to indexing and organising these works to help users find them. We do not modify, repackage, or re-upload mod files.

5.2. SimFoundry Proprietary Rights (The "Taxonomy")

‍While we do not own the mods, the organisation, structure, and categorization system used on SimFoundry is our proprietary intellectual property.

• Protected Assets: The specific "Tags," "Tag Structure," "Filters," and the "Taxonomy" (the logical arrangement of tags) developed by SimFoundry are protected by copyright and database rights.
• No Copying: You are strictly prohibited from copying, scraping, reproducing, or reverse-engineering our tagging system or taxonomy for use on any competing directory, website, or service. You may not take our unique tag combinations and simply rename them for your own commercial use.

5.3. Site Content

‍The design, layout, look, appearance, logo, and code of the SimFoundry website are owned by or licensed to us. Reproduction is prohibited other than in accordance with the copyright notice.

6. Prohibited Uses

You may use the Site only for lawful purposes. You agree not to:

• Use any automated system, including "robots," "spiders," or "offline readers," to access the Site in a manner that sends more request messages to our servers than a human can reasonably produce in the same period (i.e., no scraping).
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Site.
• Impersonate another person or otherwise misrepresent your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Steven Worrell or SimFoundry be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
